There are two steps to trademarking your name:
STEP 1: Preliminary Trademark Screening
Why preliminary screenings are important:
A preliminary trademark screen is a critical step in creating a new name. Much more intensive than what you could discover on your own doing a search on Google or the USPTO.gov website, a preliminary trademark screening through our partner, Tessera Trademark Screening, consists of an online search of US Federal, US State trademark registers, the Internet, and international marks in over 50 countries. It narrows a list of potential trademarks by “knocking out” names that are too similar to existing trademarks.

STEP 2: Register Your Name
Why trademark registration is important:
Registering your new name is important to secure your rights and enforce them against others who may want to use your good name. A Federal registration from the U.S. Federal Government will give you nationwide exclusivity, incontestability after a period of time, the right to stop counterfeits from entering the port, and it can provide the basis for registering your name in other countries. Best of all, it is only with a Federal Registration that you are permitted to use the Registered ® symbol.
